Terms of Service
This Terms of Service Agreement (“Agreement”) is entered into by and between you (“User”) and Kajo Kratzenstein, hereinafter referred to as “Taxort.com.” By accessing, downloading, installing, or using the Taxort.com website, application, or services (collectively referred to as the “Service”), you acknowledge that you have read, understood, and agree to be bound by the terms and conditions set forth herein. If you do not agree to these terms, you must not access or use the Service.
§ 1 Acceptance of Terms
By accessing or using Taxort.com, you affirm that you are at least 18 years old or have reached the age of majority in your jurisdiction and that you have the legal capacity to enter into this Agreement. Your use of the Service constitutes your acceptance of these Terms of Service.
§ 2 Description of Service
Taxort.com provides digital tools for organizing tax-related documents. The Service does not constitute tax advice, financial guidance, or legal counsel. Users are solely responsible for ensuring the accuracy and completeness of their tax filings and compliance with applicable laws.
§ 3 Payments and Refunds
(1) Users agree to pay all fees associated with their chosen subscription plan. Fees are non-refundable except as explicitly stated in this Agreement or as required by applicable law.
(2) In the event of late payments, Taxort.com reserves the right to suspend access to the Service if payment is overdue by more than fourteen (14) days. Taxort.com may also charge late fees amounting to five percent (5%) per month on overdue amounts or the maximum rate permitted by law.
(3) Taxort.com reserves the right to cancel subscriptions and issue refunds at its sole discretion. Refunds will only be granted under exceptional circumstances unless otherwise required by applicable consumer protection laws.
§ 4 Prohibited Uses
The User agrees not to engage in any of the following activities:
- (a) Cheating or Exploitation: Manipulating, exploiting, or cheating the Service, including but not limited to automating access through unauthorized means (e.g., bots, scripts), circumventing usage restrictions, or exploiting software vulnerabilities.
- (b) Account Sharing: Sharing account credentials or permitting third parties to access the Service through the User's account. Each account is intended for use by a single individual only.
- (c) Reverse Engineering: Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, structure, or algorithms of the Service, except to the extent expressly permitted by applicable law.
- (d) Illegal Activity: Using the Service for any unlawful purpose or in violation of applicable laws or regulations.
§ 5 No Warranties
The Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. Taxort.com expressly disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
Taxort.com does not guarantee that the Service will be error-free, uninterrupted, secure, or free from viruses or other harmful components. Users assume all risks associated with using the Service.
§ 6 Limitation of Liability
(1) To the maximum extent permitted by applicable law, Taxort.com shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or in connection with your use of the Service. This includes but is not limited to damages for loss of profits, data loss, business interruption, or personal injury.
(2) Taxort.com's total liability under this Agreement shall not exceed the total amount paid by the User for accessing the Service during the twelve (12) months preceding the claim.
§ 7 User Responsibilities
(1) Users are solely responsible for maintaining backups of their data outside of Taxort.com. The company does not guarantee data recovery or preservation and shall not be held liable for any data loss or corruption.
(2) Users must provide accurate payment information and ensure that all data uploaded to or processed through Taxort.com is accurate and complete.
(3) Users are responsible for complying with all applicable laws and regulations related to tax filings in their jurisdiction.
§ 8 Indemnification
The User agrees to indemnify and hold harmless Taxort.com (including its owner Kajo Kratzenstein), affiliates, employees, agents, and contractors from any claims, liabilities, damages, losses, costs (including reasonable attorney fees), or expenses arising out of:
- (a) The User's breach of this Agreement, including but not limited to violations of §4 (Prohibited Uses);
- (b) The User's use or misuse of the Service;
- (c) The User's violation of any applicable laws or regulations.
§ 9 Limitation on Claims and Timeframes
(1) All claims relating to your use of the Service must be submitted in writing to Taxort.com within thirty (30) days from the date on which the issue giving rise to the claim occurred. Claims submitted after this period will be deemed waived and invalid.
(2) To the extent permitted by applicable law, any legal action or claim arising out of this Agreement must be initiated within one (1) year from the date on which the cause of action accrues. After this period has elapsed, such claims will be permanently barred.
§ 10 Termination
(1) Taxort.com reserves the right to terminate or suspend access to its Service at any time without prior notice if:
- (a) The User violates this Agreement, including but not limited to breaches of §4 (Prohibited Uses);
- (b) The User engages in fraudulent activity or misuse of the Service;
- (c) Continued provision of the Service would be unlawful or harmful.
(2) Users may cancel their subscriptions at any time through their account dashboard. No refunds will be provided for partial subscription periods unless otherwise required by law.
§ 11 Modifications
Taxort.com reserves the right to update or modify this Agreement at any time without prior notice. Any changes will become effective upon posting on Taxort.com's website or application. Continued use of the Service after changes are posted constitutes acceptance of those changes.
Taxort.com also reserves the right to change its legal entity structure (e.g., transfer operations to a GmbH). Users will be notified via email at least thirty (30) days prior to such changes taking effect.
§ 12 Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with German law without regard to its conflict-of-law provisions. All disputes arising under this Agreement shall be subject exclusively to the jurisdiction of courts located in Potsdam, Brandenburg.
§ 13 Severability
If any provision of this Agreement is found invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from this Agreement while remaining enforceable to the maximum extent permitted by law. All remaining provisions shall continue in full force and effect.
§ 14 Entire Agreement
This Agreement constitutes the entire understanding between you and Taxort.com regarding your use of the Service and supersedes all prior agreements or understandings related thereto.
